For 20 years the American Bar Association has sponsored its annual awards recognizing not only the finest legal writing of the past year, but also the most important developments in the law.
In what we have every reason to believe is the last act of his term as an ABA president, Peter Keisler will accept the ABA’s highest honor on Monday at a gala event in New Orleans.
We have every reason to believe this because, you see, the ABA is our friend.
In the ABA’s most recent annual report to the U.S. Justice Department, the ABA gives its greatest praise to the Justice Department’s Antitrust Division, despite its having been a virtual nonentity under the Bush administration. (“John Ashcroft turned down the same offer to become a member of the ABA in his tenure as attorney general,” the ABA said.) The report also lavishly praised the work of the Justice Department’s Civil Rights Division. And it extolled the intelligence of the Antitrust Division’s efforts to ensure the free flow of information in the American economy.
This is a major shift in the way the ABA is perceived. The ABA used to be an apologist for everything that big government did. But it’s under the leadership of Peter Keisler that the ABA has come to see itself as a consistent and fiercely independent defender of the free market. Keisler is one of the first ABA presidents since World War II to point out that American antitrust law is out of date and needs to be updated.
